The following provisions establish the General Terms and Conditions of access to and use of the website of ATELIER PAULIN, available at: www.atelierpaulin.com.

Use of the website implies unconditional acceptance of all the conditions included in this legal notice. Consequently, the user must read this legal notice carefully, as the terms of use may be amended at the discretion of the site owner or due to legal, judicial, or business considerations.

The language used by ATELIER PAULIN is French. ATELIER PAULIN is not responsible for any lack of understanding or misunderstanding of the language by the user, nor for the consequences thereof.

ATELIER PAULIN is a simplified joint-stock company (SAS) with a share capital of €4,165, whose registered office is located at 229 rue Saint-Honoré, 75001 Paris. ATELIER PAULIN is registered with the Paris Trade and Companies Register (RCS Paris) under number 808 575 195 and EU VAT number FR37 808 575 195.

By accepting the General Terms and Conditions of Sale and clicking “Confirm your order”, you definitively confirm your order.

ATELIER PAULIN does not allow the sale of products without prior acceptance of the clauses below.

ARTICLE 1

Purpose: These terms define the conditions of sale between ATELIER PAULIN and the customer, from ordering to services, including payment and delivery. They govern all steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.

ARTICLE 2

Products: ATELIER PAULIN offers for sale its own jewellery and other fashion accessories within the limits of available stock. These products are those offered for sale on the date of consultation by the user. When a product is unavailable, this is indicated on the site; otherwise, in case of error, ATELIER PAULIN undertakes to inform the customer by email as soon as possible. If the product has already been paid for, ATELIER PAULIN undertakes to refund the price of the item. The products offered for sale are described and presented as accurately as possible. However, if errors or omissions occur in this presentation, ATELIER PAULIN cannot be held liable. Photographs and texts illustrating the products are not contractual.

ARTICLE 3

Product Prices: Prices are indicated in euros including VAT. They take into account the French VAT applicable on the day of the order. If the VAT rate changes, these changes will be reflected in product prices. ATELIER PAULIN reserves the right to modify its prices at any time. However, prices cannot be changed once the order has been validated. Prices do not include shipping costs, which will be added to the order total and specified to the customer when the order is finally confirmed. Delivery in mainland France is carried out within an average of 4 weeks from receipt of the order by ATELIER PAULIN, notwithstanding any unforeseen circumstances or force majeure independent of ATELIER PAULIN’s will and diligence. The amount depends on the destination country. Products remain the property of ATELIER PAULIN until full payment of the price.

ARTICLE 4

Order:

— Placing an order: The customer placing an order directly on www.atelierpaulin.com must follow the procedure: select the products of interest and click “Add to cart”. At any time the customer may: obtain a summary of selected products by clicking “My Cart” or continue shopping. The customer completes the order by clicking “Checkout”.

To correctly validate the order, the customer then specifies the delivery method according to the country. The order can only be recorded if the customer has clearly provided their first and last name, email address and delivery address (strictly personal). The user then chooses payment by credit card or PayPal and enters the appropriate payment details. A summary then appears showing: the nature, quantity and price of the selected products, the chosen payment method, the user’s contact details and the delivery address. Any order implies acceptance of the prices and description of the products available for sale. The user may then enter the word or first name to personalise their bracelet using the “Notes and instructions” field.

— Order validation: The order is validated once all fields have been completed and the “Pay now / Validate” button is clicked. ATELIER PAULIN will acknowledge receipt of the order by email as soon as it is validated.

ARTICLE 5

Payment and Transaction Security: The amount due by the customer is the amount indicated in ATELIER PAULIN’s order confirmation. To ensure payment security, atelierpaulin.com uses the secure payment services of Stripe or PayPal. Payment is made online on www.atelierpaulin.com by bank card (Visa, Mastercard, Amex, etc.) or via the user’s PayPal account. In any event, ATELIER PAULIN reserves the right to refuse any order or delivery in case of an existing dispute with the customer, non-payment in full or in part of a previous order, a refused card payment, or for any other reason that ATELIER PAULIN will explain to the customer. ATELIER PAULIN’s liability cannot be engaged in this respect.

When the order is validated, the payment request is routed in real time to the secure online payment manager, which issues an electronic certificate.

ARTICLE 6

Refunds: Pursuant to Article L221-18 of the French Consumer Code, the consumer has fourteen (14) full calendar days to exercise the right of withdrawal, without having to justify any reason or incur penalties. A refund will be made within 14 days of receipt of the jewellery, to the means of payment used for the purchase. This does not apply to personalised items expressly made to the consumer’s request.

Please note that we do not accept parcels sent “postage due”. The customer must return the item in its original packaging and with ATELIER PAULIN’s prior authorisation and return number included in the parcel. In all cases, any request for an exchange or refund must be accompanied by the return form. All items are subject to a contractual warranty, which does not affect the statutory warranty under Articles 1641 et seq. of the French Civil Code.

After this period, all non-customised products may be exchanged or credited. Exchanges must be requested within 21 days from the date of receipt or collection and returns must be accompanied by the invoice and the item’s original packaging, to the address indicated in your return authorisation.

If the new order amount is higher, the customer must pay the difference. Conversely, if the exchange amount is lower, the customer will receive a credit note for the difference directly to the customer account, valid for one (1) year.

Any damaged item that was not subject to remarks or express reservations by the customer upon delivery will be refused. To be accepted, items must be returned in their original condition and unworn. Only items returned in their original packaging (box) will be accepted. Consequently, returns of worn items and damaged packaging will be refused. ATELIER PAULIN reserves the right to accept or refuse the returned item depending on its condition. All items are subject to a contractual warranty, which does not affect the statutory warranty under Articles 1641 et seq. of the Civil Code. Users also benefit from the legal guarantee allowing them to return defective items delivered, pursuant to Articles L 211-4 et seq. of the Consumer Code.

How to return an item:

  • Complete the return form available on the website in the “Delivery & Returns” section.
  • Use the original packaging to return the product.
  • Send your parcel to the address indicated in your return authorisation. For exchanges within France (exchange only), the second shipment is offered.

Refunds for defective products: If the product has a defect or breaks within 14 days, it will be refunded to the original payment method. ATELIER PAULIN reserves the right to assess whether a product is defective based on the customer’s explanations. The product is considered defective if the metal wire snaps cleanly without abnormal deformation of the letters and without evidence of cutting by a sharp object. ATELIER PAULIN undertakes to refund within 14 days by bank card or cheque at the customer’s discretion.

In the event of a dispute not resolved amicably following a written complaint, you may refer the matter to the consumer mediator: Centre de la Médiation de la Consommation de Conciliateurs de Justice, 14 rue Saint-Jean, 75017 Paris (President: Mr Alain Yung-Hing).

ARTICLE 7

Intellectual Property: All elements of the ATELIER PAULIN site such as products, visuals and underlying technology are protected and any fraudulent use will be prosecuted. They are the exclusive property of ATELIER PAULIN. Any user wishing to place, for personal use, a simple link on their personal site pointing directly to ATELIER PAULIN’s site must first request authorisation. Any hyperlink using framing, deep-linking, in-line linking or any other deep-link technique is strictly prohibited. Any link, even tacitly authorised, must be removed upon simple request by ATELIER PAULIN. Hyperlinks may refer to sites other than www.atelierpaulin.com; ATELIER PAULIN accepts no responsibility if the content of such sites contravenes applicable laws and regulations.

ARTICLE 8

Data Protection: For the purposes of its activity, ATELIER PAULIN reserves the right to collect personal data concerning site users, in particular via cookies; the consumer acknowledges this. Automated processing of information, including management of user email addresses, has been declared to the CNIL under number 1840453. In all cases, and in accordance with the law of 6 January 1978, the consumer has a right of access and rectification to any information concerning them held by ATELIER PAULIN. Any site customer may at any time object to the commercial use of said data and also has rights of access, rectification and deletion, directly online via the site’s contact section.

ARTICLE 9

Signature and Proof: Online provision of a bank card number and final validation of the order constitute proof of the entirety of said order pursuant to the law of 13 March 2000 and imply the exigibility of the amounts due for the items entered on the order form. This validation constitutes signature and express acceptance of all operations carried out on the site. In the event of fraudulent use of a bank card, the customer is invited to contact ATELIER PAULIN’s customer service via the contact form. Computer records kept in ATELIER PAULIN’s systems and those of its partners under reasonable security conditions will be considered proof of communications, orders and payments between the parties. In all cases, order validation, whether payment is made by bank card directly on the site, constitutes signature and express acceptance of all operations carried out on the site.

ARTICLE 10

Customs Duties: Any order placed on the site and delivered outside France may be subject to taxes and customs duties imposed when the parcel reaches its destination. These duties and possible taxes related to delivery are borne by the customer and are their responsibility. ATELIER PAULIN is not required to check and inform customers of applicable customs duties and taxes; customers must inquire with the competent authorities in their country.

Disputes / Governing Law: The language of these terms is French. This contract is governed by French law. In the event of a dispute with a customer, the French courts shall have exclusive jurisdiction.

ARTICLE 11

Entire Agreement: These general terms and the order summary sent to the customer form a contractual whole and constitute the entire contractual relationship between the parties.

ARTICLE 12

Delivery: Products are shipped to the delivery address indicated by the customer when placing the order. The timeframe is between 4 and 10 business days (see the “delivery & returns” tabs on each product page).

The indicated delivery times are estimates from the day after the order is validated by the customer and correspond to processing and delivery times. They are not binding; in the event of an unusual delay, you will be notified by email. ATELIER PAULIN declines any responsibility in case of extended delivery times due to postal services or transport, as well as in case of loss or strike. Transport risks are borne by the customer, who must submit a reasoned complaint to the postal services or carrier within three business days of delivery.

Despite all the care taken by ATELIER PAULIN in preparing parcels, a product may be missing or damaged after transport. Upon receipt, the customer must check conformity. Any anomaly (missing or broken product, damaged parcel) must be notified on the day of receipt or no later than the next business day to ATELIER PAULIN customer service by registered letter (address as indicated in your order documents).

Any claim made after this period will be rejected and ATELIER PAULIN will be released from all liability. ATELIER PAULIN may ask the customer to return the defective product. If the above conditions are met, ATELIER PAULIN will exchange, refund the defective product(s) or reship the missing product (subject to the validity of the Buyer’s request).

Delivery Times and Rates: Times indicated are the indicative transit times of our carriers in business days, added to production time. All prices are in euros. Colissimo tracked parcels are delivered by La Poste within 2 to 5 business days (for mainland France) to the delivery address indicated on your order form.

In case of absence, a notice will indicate collection conditions (place and deadlines). Holding periods are generally 15 days. You can track your parcel on www.coliposte.net.

To obtain your Colissimo number, please contact customer service via the contact form, stating your name and order number. If you have not received your tracked Colissimo after 10 days and no notice was left, check your parcel status on the Coliposte website and contact us via the contact form.

Damaged parcel: Please do not accept a damaged parcel (box showing visible signs of opening and/or deterioration): it must be refused. Parcels leave ATELIER PAULIN in perfect condition and must be delivered as such. If a damaged parcel was deposited in your mailbox or accepted by a concierge, the parcel is deemed “accepted as is”. Without reservations, we cannot process any claim or compensation.

ARTICLE 13

Opt-out from Telephone Marketing

Information provided by the Customer when ordering, in particular landline and/or mobile numbers and those of the recipient, are collected solely to ensure proper execution and delivery of the order. However, in accordance with Article L.223-2 of the French Consumer Code, the Customer has the right to register free of charge on the Bloctel telephone marketing opt-out list, which protects consumers from abusive telemarketing practices.
