GENERAL CONDITIONS OF SALE AND USE

The following provisions establish the General Conditions of access and use of the ATELIER PAULIN company website accessible at the following address: www.atelierpaulin.com.

Use of the site implies unreserved acceptance of all the conditions included in this legal notice. Therefore, the user must read this legal notice carefully, as the conditions of use are subject to change at the discretion of the owner of the site or due to legal, judicial or commercial criteria.

The language used by ATELIER PAULIN is French. ATELIER PAULIN is not responsible for the user's lack of understanding or misunderstanding of the language, nor for its consequences.

The company ATELIER PAULIN makes it impossible to sell products without having first accepted the clauses below.

ARTICLE 1

PURPOSE: These conditions aim to define the terms of sale between ATELIER PAULIN and the customer, from the order to the services, including payment and delivery. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.

ARTICLE 2

PRODUCTS: ATELIER PAULIN aims to offer for sale its own jewelry and other fashion accessories within the limit of available stocks. These products are those listed for sale on the day of consultation by the user. When the product is unavailable, it is displayed on the site, otherwise, in the event of an error, ATELIER PAULIN undertakes to notify the customer by email as soon as possible. If the product has already been paid for, ATELIER PAULIN undertakes to reimburse the customer for the price of the item. The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, ATELIER PAULIN cannot be held liable. The photographs and texts illustrating the products are not part of the contractual scope.

ARTICLE 3

PRODUCT PRICES: Prices are indicated in Euros including VAT. They take into account French VAT, applicable on the day of the order. If the VAT rate were to be modified, these changes would be reflected in the price of the items. ATELIER PAULIN reserves the right to modify its prices at any time. However, these prices could only be modified once the order has been validated. The prices indicated do not take into account shipping costs which will be added to the total of the order and will be specified to the customer upon final validation of their order. Delivery in Metropolitan France is made within an average of 4 weeks from receipt of the order by ATELIER PAULIN, notwithstanding any fortuitous event or force majeure which would delay delivery independently of the will and diligence of ATELIER PAULIN. Its amount depends on the country of delivery. The products remain the property of ATELIER PAULIN until full payment of the price.

ARTICLE 4

ORDER :

- REGISTRATION OF AN ORDER: The customer who places an order directly on the site www.atelierpaulin.com must follow the following procedure: The customer will choose the different products in which he is interested and will successively click on the link "Add to card / Add to my basket". At any time he will have the possibility: Either to obtain a summary of the selected products by clicking on the link "My Card / My basket" or to continue his purchases. The customer will complete his order by clicking on "Checkout / Payment"

In order to correctly validate his order. He then specifies the chosen delivery method according to the country. The order can only be registered on the site if the customer has clearly entered his name, first name and email address and delivery address which are strictly personal to him. Then the user must choose between payment by credit card or payment by paypal and enter the appropriate data for the chosen payment method. Then appears the summary of his order summarizing: the nature, quantity and price of the products selected by the user, as well as the chosen payment method, the user's contact details and the delivery address of the package. Any order constitutes acceptance of the prices and description of the products available for sale. The user can then enter the word or first name that will personalize his bracelet using the "Notes and instructions" field.

- ORDER VALIDATION: The order is validated once all fields have been completed by the customer and the “Pay now / Validate” button. ATELIER PAULIN will acknowledge receipt of the order upon validation by email.

ARTICLE 5

PAYMENT AND SECURITY OF TRANSACTIONS: The amount owed by the customer is the amount indicated during the order confirmation of ATELIER PAULIN. In order to ensure the security of payments, the site atelierpaulin.com uses the secure payment service of Stripe or paypal; Payment will be made on the Internet on the site www.atelierpaulin.com by Bank Card (Bleue, Visa, Eurocard / Mastercard) or by the user's paypal account. In any event, ATELIER PAULIN reserves the right to refuse any order or delivery in the event of an existing dispute with the customer, total or partial non-payment of an order, a payment by credit card refused or for reasons other than ATELIER PAULIN reserves the right to explain to its customer. The liability of ATELIER PAULIN can then in no case be engaged in this regard.

When the order is validated, the payment request is routed in real time to the secure telepayment manager. The telepayment manager issues an electronic certificate.

ARTICLE 6

REFUND

According to Article L221-18 of the Consumer Code, the consumer has a period of fourteen calendar days to exercise his right of withdrawal, without having to provide a reason or incur penalties. A refund will be made within 14 days upon receipt of the jewel on the means of payment used for the purchase. This does not apply to personalized jewelry. Personalized at the express request of the consumer.

Please note that we do not accept packages sent with postage due. However, the customer must return the item in its original packaging and must be returned with the authorization of ATELIER PAULIN and its return number included in the package giving a specific date to this shipment. In all cases, any request for exchange or refund must be accompanied by the return form. All items are subject to a contractual guarantee, which does not prevent the legal guarantee provided for by articles 1641 and following of the Civil Code.

After this period, all non-personalized products can be exchanged or credited. The exchange must take place within 21 days from the date of receipt or withdrawal and the return of the item(s) within this period must be accompanied by the invoice for the item in its original packaging to the following address:

If the new order is for a higher amount, the customer must attach to the exchange request the payment of the balance by check. Conversely, if the amount of the exchange is less than the initial amount, the customer will receive a credit for the difference directly into their customer account, valid for one (1) year.

Any damaged item that has not been the subject of express remarks or reservations by the customer upon delivery will be refused by the seller. To be accepted by ATELIER PAULIN, the items must be returned in their original condition without having been worn. Only items returned in their original packaging (box) will be accepted. Consequently, returns of worn items, as well as damaged packaging will be refused. ATELIER PAULIN therefore reserves the right to accept or refuse the returned item depending on its qualitative condition. All items are subject to a contractual guarantee, which does not prevent the legal guarantee provided for by articles 1641 et seq. of the Civil Code. The user benefits from a guarantee for the items allowing him to return defective items delivered in accordance with articles L 211-4 et seq. of the Consumer Code.

To return an item, simply follow these instructions:

  • Complete the return form available on the website in the delivery and returns category.
  • Use the original packaging to return the product.
  • Send your package to the following address: ATELIER PAULIN, 60 rue de Richelieu, 75002 Paris. In the case of an exchange in France (and an exchange only), the shipping costs for the second shipment are free.

• Reimbursement of defective products: If the product is defective or a component breaks and is declared within 14 days, it will be reimbursed using the payment method used for the purchase. ATELIER PAULIN reserves the right to judge a product as defective, based on the customer's explanations. The product will be considered defective if the metal wire breaks cleanly without any abnormal deformation of the letters making up the bracelet being observed and without the precious metal wire having been cut by a sharp or cutting object. ATELIER PAULIN undertakes to reimburse within 14 days by credit card or check, at the customer's discretion.

In the event of a dispute not resolved by an amicable solution and having been the subject of a written complaint addressed by the consumer customer to the company, you can submit the dispute to the consumer mediator whose contact details are as follows: The Consumer Mediation Center of Conciliators of Justice. ARTICLE 7

INTELLECTUAL PROPERTY: All elements of the ATELIER PAULIN website such as products, visuals, including the underlying technology, are protected and any fraudulent use will be prosecuted. They are the exclusive property of ATELIER PAULIN. The user who has a personal website and who wishes to place, for personal use, on his site a simple link directly referring to the ATELIER PAULIN website, must first request authorization from ATELIER PAULIN. Furthermore, any hyperlink referring to the ATELIER PAULIN website and using in particular the technique of framing, deep-linking, in-line linking or any other deep link technique is in any case formally prohibited. In all cases, any link, even tacitly authorized, must be removed at the simple request of ATELIER PAULIN. Hyperlinks may refer to sites other than www.atelierpaulin.com. The latter disclaims all liability in the event that the content of these sites contravenes the laws and regulations in force.

ARTICLE 8

DATA PROTECTION AND FREEDOM: ATELIER PAULIN, for the purposes of its business, reserves the right to collect personal data relating to users of the site, in particular by means of "cookies". The consumer acknowledges being aware of this. To this end, the automated processing of information, in particular the management of user email addresses, has been declared to the CNIL under number 1840453. In all cases, and in accordance with the law of 6 January 1978, the consumer also has a right of access and rectification with regard to any information concerning them appearing in the files of the company ATELIER PAULIN. Any customer of the site may at any time object to the commercial use of said data and also benefits from a right of access, rectification and deletion of data concerning them, directly on the Internet via the contact section of the site.

ARTICLE 9

SIGNATURE AND PROOF: In all cases, the online provision of the bank card number and the final validation of the order will constitute proof of the entirety of said order in accordance with the provisions of the law of March 13, 2000 and will constitute the due date of the sums committed by the entry of the items appearing on the order form. This validation constitutes a signature and express acceptance of all operations carried out on the site. However, in the event of fraudulent use of his bank card, the customer is invited, as soon as this use is noted, to contact ATELIER PAULIN customer service by sending an email via the contact form on the Contact Us page. The computerized records, stored in the computer systems of ATELIER PAULIN and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. In all cases, validation of the order, whether payment is made by bank card directly on the site, constitutes signature and express acceptance of all operations carried out on the site.

ARTICLE 10

CUSTOMS DUTIES: Any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties that are imposed when the package reaches its destination. These customs duties and possible taxes related to the delivery of an item are the responsibility of the customer. ATELIER PAULIN is not required to check and inform its customers of the applicable customs duties and taxes. To find out about them, it is up to the member to inquire with the competent authorities in their country.

Disputes/APPLICABLE LAW The language of these general terms and conditions of sale is French. This contract is subject to French law. And in the event of a dispute with a customer, the French courts will have sole jurisdiction.

ARTICLE 11

ENTIRE CONTRACT: These general terms and conditions of sale and the order summary sent to the customer form a contractual whole and constitute the entirety of the contractual relations between the parties.

ARTICLE 12

DELIVERY: The products are shipped to the delivery address indicated by the customer when ordering. The delivery time is between 4 and 10 working days (see the "deliveries and returns" tabs on each product page).

The delivery times indicated are indicative times from the day following the day of validation by the customer of his order and correspond to the processing and delivery times of the products. Under no circumstances can they be enforceable, but in the event of an unusual delay, an email will be sent to you. ATELIER PAULIN therefore declines all responsibility in the event of excessively long delivery times due to postal services or means of transport, as well as in the event of loss of the products ordered or strike. The risks of transport are borne by the customer, who must make a reasoned protest to the postal services or to the carrier, within three working days of delivery.

That being said, despite all the care taken by ATELIER PAULIN in preparing the packages, a product may be missing. Similarly, after transporting the package, one of the products may be defective. This is why, upon receipt of the order, the customer will ensure that the products received are compliant. Any anomaly concerning the delivery (missing or broken product, damaged package) must be notified, on the same day of receipt or at the latest on the first working day following receipt, to ATELIER PAULIN customer service by registered mail (addressed to ATELIER PAULIN 60 rue de Richelieu 75002 Paris).

Any claim made after this deadline will be rejected and ATELIER PAULIN will be released from any liability. ATELIER PAULIN reserves the right to ask the customer to return the defective product. If the above conditions are met, ATELIER PAULIN will then proceed to exchange, refund the defective Product(s), or reship the missing product (subject to the validity of the Buyer's request).

DELIVERY TIMES AND RATES: The times indicated are the indicative delivery times of our carriers in working days added to the manufacturing time. All prices are in euros. The tracked Colissimo is delivered by La Poste in 2 to 5 working days (for mainland France). It is delivered to the delivery address indicated on your order form.

In case of absence, the postman will leave you a notice of passage, indicating the conditions for collecting your parcel (place and deadlines). The processing times are generally 15 days. You can follow the progress of your parcel on the website www.coliposte.net.

In order to have your colissimo number, please send an email to customer service via the contact form, specifying your name, first name and order number. If you have not received your colissimo tracking after 10 days and no delivery notice has been left for you, remember to check the status of your package on the coliposte website (and contact us via the contact form.)

Damaged package: We ask you not to accept a damaged package (box with visible signs of opening and/or deterioration): it must be refused. In fact, packages leaving ATELIER PAULIN warehouses are always impeccable, and must be delivered to you in this condition. If a damaged package has been placed in your mailbox or your caretaker has received it, the package is considered "accepted as is". If no reservation has been made, we will not be able to take into account any possible disappearances, nor to make any compensation.

ARTICLE 13

OPPOSITION TO TELEPHONE CANVASSING

The information provided by the Customer when placing an order, in particular their landline and/or mobile telephone number and that of the recipient, is only collected to enable the proper execution and delivery of the order. However, in accordance with Article L.223.2 of the Consumer Code, the Customer has the right to register free of charge on the Bloctel telephone canvassing opposition list. The Bloctel list protects consumers from abusive telephone marketing practices. Bloctel is a service that allows you to register your number, that of your spouse or children to oppose telephone canvassing on these numbers.
